These Terms and Conditions (“Terms”) govern your use of the Website and your purchase, receipt or use of any products made available through it (“Products”). By accessing the Website or purchasing Products, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website. We may update these Terms at any time. Your continued use of the Website means you accept the updated Terms.

In these terms and conditions, the following definitions apply:

• Consumer: the natural person who is not acting in the course of a profession or business
• Webshop: the online store of FOUR Amsterdam, accessible via www.fouramsterdam.com
• Product: clothing, accessories, and related fashion items offered by FOUR Amsterdam
• Agreement: the purchase agreement between FOUR Amsterdam and the consumer
• Cooling-off period: the period of 14 days during which the consumer can exercise the right of withdrawal
• Right of withdrawal: the right of the consumer to withdraw from the agreement within the cooling-off period.

These general terms and conditions apply to every offer made by FOUR Amsterdam and to every agreement concluded between FOUR Amsterdam and the consumer.

Before the agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated how the general terms and conditions can be viewed.

If the agreement is concluded electronically, the text of these general terms and conditions can be made available to the consumer electronically so that it can be easily stored.

You may use the Website only for personal and lawful purposes. You must not:

• Copy or reproduce Website content
• Use bots, scrapers or automated tools
• Access systems without authorization
• Introduce harmful code
• Interfere with Website performance or security
• Misrepresent your identity
• Use the Website for unlawful activities

Electronic communication with us counts as valid written communication. We may restrict access if you violate these Terms.

Om een bestelling te voltooien, moeten klanten correcte persoonlijke gegevens verstrekken, waaronder naam, verzendadres, factuurgegevens, e-mailadres en betaalinformatie. Deze gegevens zijn nodig voor orderverwerking, communicatie, fraudepreventie en levering.

1. Als een aanbieding een beperkte geldigheidsduur heeft of onder voorwaarden valt, wordt dit uitdrukkelijk in de aanbieding vermeld.

2. De aanbieding bevat een volledige en nauwkeurige omschrijving van de aangeboden producten, inclusief:

- Maten, kleuren en materiaalsamenstelling
- Prijs inclusief alle belastingen
- Eventuele verzendkosten

3. Afbeeldingen en specificaties in de aanbieding zijn zo nauwkeurig mogelijk, maar kleine afwijkingen kunnen niet volledig worden uitgesloten.

4. Alle afbeeldingen en specificaties zijn indicatief en kunnen geen aanleiding geven tot schadevergoeding of ontbinding van de overeenkomst.

Productbeschikbaarheid is niet gegarandeerd en wij kunnen informatie op elk moment aanpassen of corrigeren.

If an item becomes unavailable after ordering, we will notify you. You may choose:

• A replacement Product
• A FOUR Amsterdam gift card

• A full refund

If we do not receive your preference within a reasonable period, we will issue a refund.

Alle prijzen zijn inclusief btw indien van toepassing en exclusief verzendkosten, tenzij anders vermeld. Betaalmethoden worden weergegeven bij het afrekenen. De betaling moet zijn voltooid voordat wij je bestelling verzenden.

Als een product door een fout onjuist geprijsd is, kunnen wij de bestelling annuleren. Je kunt ervoor kiezen om door te gaan tegen de juiste prijs of een terugbetaling te ontvangen.

Overeenkomst

• De overeenkomst komt tot stand op het moment dat de consument het aanbod aanvaardt en voldoet aan de daarbij gestelde voorwaarden.
• FOUR Amsterdam bevestigt de bestelling zo snel mogelijk per e-mail. Zolang de ontvangst van deze bevestiging niet is bevestigd, kan de consument de overeenkomst ontbinden.

• De consument kan de overeenkomst niet ontbinden als FOUR Amsterdam de producten al heeft geleverd.

Customers may request cancellation before the order has shipped. We will confirm whether cancellation is still possible. We may decline or cancel orders due to errors, payment issues, suspected fraud or stock limitations. Refunds are issued for cancelled orders.

Orders are shipped to the address provided at checkout.
Delivery times shown during checkout are indicative and not guaranteed unless clearly stated otherwise. FOUR Amsterdam will take reasonable care in packaging and dispatching the Products. FOUR Amsterdam will inform the Consumer as soon as possible if delivery is delayed or cannot be completed as agreed. In the event of a delay or if an order cannot be fulfilled or can only be partially fulfilled, FOUR Amsterdam will inform the Consumer no later than 30 days after the order was placed. In that case, the Consumer has the right to terminate the Agreement without incurring any costs and to receive a full refund.

If delivery cannot occur within 30 days for reasons within our control, you may cancel the order and receive a full refund.

International shipments may require customers to pay customs duties, import taxes or clearance fees. These costs, and any related delays, are the responsibility of the customer. If a package is refused due to unpaid duties, the carrier may return or destroy it. Costs may be deducted from any refund.

EU, EEA and UK consumers: risk transfers upon delivery.
Consumers outside the EU: local mandatory laws may apply differently.

1. The consumer has the option to choose pickup at the FOUR Amsterdam store at Van Baerlestraat 9-11 in Amsterdam.

2. As soon as the order is ready for pickup, the consumer will receive an email notification at the email address provided by him/her.

3. The consumer must pick up the order within 7 days of receiving notification that the order is ready, during the store's opening hours.

4. After 3 days, the consumer will receive a reminder that the order has not yet been picked up. From this moment on, the consumer has another 4 days to pick up the order.

5. If the order is not collected within the 7-day period:

• The order will be automatically canceled
• An administration fee of €15.00 will be charged

• The remaining amount (purchase price minus €15.00 administration fee) will be refunded within 7 working days

6. The statutory cooling-off period of 14 days begins when the consumer actually picks up the order in the store.

7. Upon pickup, the consumer must present valid identification and the order confirmation (digital or on paper).

8. The risk of damage and/or loss of products is transferred to the consumer at the time of pickup in the store.

1. Gedurende de in de aanbieding vermelde geldigheidsduur worden de prijzen van de aangeboden producten niet verhoogd, behalve prijswijzigingen als gevolg van veranderingen in btw-tarieven.

2. Alle prijzen zijn in euro’s, inclusief btw en exclusief verzendkosten, tenzij anders vermeld.

3. De verzendkosten worden tijdig en duidelijk aan de consument gecommuniceerd voordat de overeenkomst wordt gesloten.

Promotiecodes kunnen:

• Uitsluitingen of een minimumbedrag bevatten
• Eenmalig gebruikt worden, tenzij anders vermeld

• Niet met terugwerkende kracht worden toegepast

• Niet worden ingewisseld voor contant geld

Terugbetalingen zijn gebaseerd op het betaalde bedrag na korting.

Cadeaubonnen:

• Kunnen online worden gebruikt

• Kunnen niet worden ingewisseld voor contant geld

• Eventueel resterend saldo kan worden gebruikt voor toekomstige aankopen.

1. FOUR Amsterdam accepteert de volgende betaalmethoden: iDEAL, creditcard, PayPal, Klarna, KBC/CBC en GiroPay.

2. Voor online betalingen worden beveiligde betaalsystemen gebruikt.

3. De consument is verplicht om onjuistheden in verstrekte of vermelde betaalgegevens onverwijld aan FOUR Amsterdam te melden.

Consumenten binnen de EU en EER kunnen de overeenkomst binnen 14 dagen na ontvangst van de bestelling herroepen.

De bedenktijd gaat in op de dag nadat het product is ontvangen door de consument of een vooraf door de consument aangewezen en aan FOUR Amsterdam bekendgemaakte vertegenwoordiger.

Om te herroepen, dient de consument een duidelijke verklaring per e-mail te sturen of gebruik te maken van het modelformulier voor herroeping. Producten moeten binnen 14 dagen na herroeping worden geretourneerd.

Het risico en de bewijslast voor een juiste en tijdige uitoefening van het herroepingsrecht liggen bij de consument.

Retourvoorwaarden

Items moeten ongedragen, ongewassen, ongewijzigd, onbeschadigd en in de originele verpakking met aangehechte labels worden geretourneerd. De kosten voor retourzending zijn voor rekening van de consument.

FOUR Amsterdam mag de terugbetaling uitstellen totdat het geretourneerde product is ontvangen. FOUR Amsterdam gebruikt dezelfde betaalmethode voor terugbetalingen, tenzij de consument instemt met een andere methode. Terugbetalingen zijn kosteloos voor de consument.

De terugbetaling kan worden verminderd als het product meer is gebruikt dan nodig is om het te beoordelen.

Retourprocedure (EU en EER)

1. De consument kan een retour aanmelden via de QR-code op de factuur of door contact op te nemen met de klantenservice van FOUR Amsterdam.

2. Producten die via de webshop zijn gekocht, kunnen worden geretourneerd door:

a. Het product te verzenden naar het retouradres (kosten circa €4,00 – €7,00, voor rekening van de consument)

b. Het product terug te brengen in de FOUR Amsterdam winkel (kosteloos)

3. Producten die in de fysieke winkel zijn gekocht, kunnen worden geretourneerd door contact op te nemen met de klantenservice van FOUR Amsterdam voor instructies.

4. Bij het retourneren van producten moeten alle items in originele staat worden teruggestuurd: ongedragen, ongewassen, ongewijzigd, met labels nog bevestigd en inclusief eventuele productverpakking en dustbags.

5. De verwerking van een retour kan tot 14 werkdagen duren. De terugbetaling wordt zichtbaar afhankelijk van de gebruikte betaalmethode.

Withdrawal does not apply to:

• Personalised or custom-made items
• Underwear or swimwear with broken hygiene seals

• Items unsuitable for return due to health or hygiene reasons once opened

Products must meet the Agreement and EU standards.

If a Product does not conform to the Agreement, the Consumer is entitled to a free repair or replacement. If repair or replacement is not possible or reasonable, the Consumer may be entitled to a price reduction or termination of the Agreement.

EU Consumers have a 2-year legal warranty.
Defects must be reported within a reasonable period. Two months is considered timely. Depending on the situation, remedies may include repair, replacement, price reduction or cancellation. Always follow care instructions.
Damage caused by improper washing or handling is excluded.
Normal wear and tear is not covered.

Creating an account is optional. If you choose to check out as a guest, providing a valid email address and delivery address is required to process and deliver your order. You are responsible for maintaining accurate information and keeping login details secure. We may suspend or terminate accounts for misuse, fraud or violations of these Terms.

All content on the Website, including images, videos, logos, designs, layout and written content, is owned by FOUR Amsterdam or its licensors.

You may not:

• Reproduce, publish or distribute content
• Use trademarks without written permission

• Extract data using automated tools
• Frame or mirror the Website

Unauthorized use terminates your access rights.

Nothing limits liability where such limitation is unlawful. To the fullest extent permitted by law:

• FOUR Amsterdam is not liable for indirect, incidental or consequential damages
• Total liability is limited to the amount paid for the relevant order

• We are not liable for delays caused by factors outside our control
• We are not liable for damage caused by misuse or improper care

You agree to indemnify FOUR Amsterdam against third-party claims arising from misuse of the Website, breach of these Terms, violations of law or infringement of intellectual property rights.

Complaints must be submitted as soon as possible and clearly described. FOUR Amsterdam will confirm receipt of the complaint and provide a substantive response within 14 days. EU consumers may use the European Online Dispute Resolution platform. These Terms are governed by Dutch law.
EU, EEA and UK consumers retain rights under mandatory local laws.

Events such as natural disasters, strikes, transport interruptions, pandemics, government restrictions or severe logistic disruptions may constitute force majeure.
During such events, FOUR Amsterdam is temporarily relieved from its obligations.

We may update these Terms at any time.
Invalid provisions do not affect the remainder. Failure to enforce a right does not waive that right.
You may not transfer your rights; we may assign ours where legally allowed.
These Terms form the entire agreement for online purchases.

We process personal data in accordance with GDPR.
